JioHotstar Domain Dispute: What is cybersquatting?
Cybersquatting is a situation in which a person or organization registers a domain name similar to the name of a well-known brand or company. The aim is usually to make money from that brand or company, either by selling the domain name or by showing advertisements on it. Is cybersquatting punishable in India? Under Section 43A of the Information Technology Act, 2000, any person can be punished for using the name, domain name, trademark or service mark of another person in cyberspace with the intent to infringe the legitimate rights of that other person. JioHotstar Domain Dispute Recently, a Delhi-based developer made headlines when he revealed that he owns the jiohotstar.com domain name. The developer had bought the domain name some time back, predicting the possible merger of Reliance JioCinema and Disney+ Hotstar. When Reliance was completing regulatory approvals for its merger with JioCinema streamer, the developer posted a letter addressed to Reliance Industries officials requesting them to fund his higher education in exchange for the domain. The letter led to a standoff between the developer and Reliance over the domain. However, it now seems to have come to an end.
The telecom giant had disputed the ownership of the domain with Marketing Total, a St Kitts-based company that had registered the domain name. The World Intellectual Property Rights Organization (WIPO), an international intellectual property rights watchdog, had ruled in favour of Bharti Airtel. “The domain name registered by the respondent is either identical or confusingly similar to a trademark or service mark possessed by the complainant (Bharti Airtel). The respondent has no right or legitimate interest in respect of the domain name and it has been registered and is being used in bad faith,” a WIPO panelist said.
